§ 1 Scope
(1) These General Terms and Conditions (hereinafter "GTC", German "AGB") apply to all business relationships between Marc Jenisch, Meine Perlen, Christian-Pless-Strasse 11-13, 63069 Offenbach am Main (hereinafter "Operator") and the customer.
(2) The version of these GTC valid at the time of booking shall apply in each case.
(3) Deviating terms and conditions of the customer are not recognised unless the Operator expressly agrees to their validity in writing.
§ 2 Access requirements
(1) The use of our website and services is permitted exclusively to persons who have reached the age of 18.
(2) By using our website, the customer confirms that he is of legal age and complies with the applicable laws of his country of residence.
§ 3 Description of services
(1) Meine Perlen offers escort services in the area of Offenbach am Main, Frankfurt and in the Rhine-Main region.
(2) The type and scope of the services are set out in the respective booking confirmation and in the profile information published on the website.
(3) The Operator reserves the right to change or extend the services offered at any time, provided that this is reasonable for the customer.
§ 4 Booking and conclusion of contract
(1) A booking can be made via our website, by phone or by email. The presentation of the services on the website does not constitute a legally binding offer, but an invitation to submit a booking request.
(2) The contract is concluded upon the booking confirmation by the Operator.
(3) For online bookings, availability is checked in real time. A completed online booking is deemed to be a booking confirmation.
§ 5 Prices and payment
(1) All prices stated on the website and in the profiles are final prices in euros.
(2) For escort bookings, a distance-based travel fee is charged in addition to the base price; this fee is clearly displayed to the customer before the booking is completed.
(3) Payment is made on site at the start of the visit. Several payment methods are available: cash, card payment and an ATM on the premises. Prepayment is not required.
(4) The Operator reserves the right to change prices at any time. For bookings already confirmed, the price valid at the time of booking applies.
§ 6 Cancellation and no-show
(1) Cancellation free of charge is possible up to 2 hours before the agreed appointment. Cancellation can be made via the link contained in the confirmation email or by phone.
(2) In the event of cancellation after the deadline has expired or if the customer does not show up, the Operator may charge a cancellation fee.
§ 7 Discretion and confidentiality
(1) All personal data is treated as strictly confidential and is not passed on to third parties. Further details are set out in our privacy policy.
(2) The customer undertakes not to make any photo, audio or video recordings during the visit.
§ 8 House rules and code of conduct
(1) The Operator exercises the domestic authority (Hausrecht) and is entitled to expel persons from the premises without giving reasons.
(2) The customer undertakes to treat the girls with respect and to adhere to the agreed services.
(3) The consumption of illegal substances on our premises is prohibited.
§ 9 Liability
(1) The Operator is liable for damages only in cases of intent or gross negligence. Liability for slight negligence is excluded, provided that no material contractual obligations are breached.
(2) Liability for indirect damages, consequential damages and loss of profit is excluded.
(3) The above limitations of liability do not apply to damages arising from injury to life, body or health.
§ 10 Force majeure
In the event of force majeure (e.g. natural disasters, pandemics, orders by public authorities) that make the provision of services impossible or considerably more difficult, the Operator is released from the obligation to perform. In such a case, the customer has no claim to damages.
§ 11 Final provisions
(1) The law of the Federal Republic of Germany applies.
(2) The place of jurisdiction for all disputes arising from or in connection with these GTC is Offenbach am Main, provided that the customer is a merchant (Kaufmann), a legal entity under public law or a special fund under public law.
(3) Should any provision of these GTC be invalid or unenforceable, the validity of the remaining provisions shall remain unaffected. The invalid provision shall be replaced by a provision that comes closest to the economic purpose of the invalid provision.
